1. INTRODUCTION

These Terms and Conditions ("Terms") govern your access to and use of BookMyMandap.in ("Platform", "we", "us", or "our"), a trademark owned and operated by SKYNOR PROPERTIES PRIVATE LIMITED (CIN: U70100KL2011PTC029769), having its registered office at POOPPAS NEST NARUKAMPULLY, KANJIKODE WEST PO, PALAKKAD, Kerala, India, 678623. The Platform is an online marketplace that connects Customers seeking to book venues such as mandaps, wedding halls, auditoriums, and convention centers ("Venues") with Venue Owners who list their properties for booking.

By accessing or using the Platform, registering an account, browsing Venue listings, making a booking, or listing a Venue, you agree to be bound by these Terms, along with our Privacy Policy, Payment Gateway Policy, and Refund and Cancellation Policy (collectively, the "Policies"). If you do not agree to these Terms, you must not use the Platform.

These Terms apply to all users, including Customers (individuals or entities booking Venues), Venue Owners (individuals or entities listing Venues), and visitors. We reserve the right to modify these Terms at any time, with changes effective upon posting on the Platform. We will notify you of material changes via email or Platform notification. Continued use after changes constitutes acceptance.

2. ELIGIBILITY AND ACCOUNT REGISTRATION

2.1 Eligibility

You must be at least 18 years old and capable of forming a legally binding contract under Indian law to use the Platform. By using the Platform, you represent that you meet these requirements. If you are using the Platform on behalf of an entity, you represent that you are authorized to bind that entity. We may refuse service to anyone for any reason, including if you are located in a jurisdiction where use of the Platform is prohibited.

2.2 Account Creation

To book or list a Venue, you must create an account by providing accurate information, including your name, email address, mobile number, and any other required details. You agree to update your information as needed to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use at support@bookmymandap.in.

2.3 Verification

We may verify your identity, including through email, SMS, or document submission (e.g., Aadhaar, PAN for Indian users, or equivalent for others). Venue Owners must provide proof of ownership or authorization to list Venues, such as property documents, agreements, or licenses. Failure to provide verification may result in account suspension.

2.4 Account Suspension/Termination

We reserve the right to suspend or terminate your account for violations of these Terms, fraudulent activity, repeated cancellations, negative reviews impacting the Platform, or at our discretion. Upon termination, you lose access to your account, but any ongoing obligations (e.g., payments, unresolved disputes) remain. Terminated users may not create new accounts without our written permission.

3. PLATFORM SERVICES

3.1 For Customers

  • Search and discover Venues based on location, capacity, amenities, pricing, and reviews.
  • Request bookings by selecting dates, providing event details (e.g., number of guests, event type), and making payments as per the Payment Gateway Policy.
  • Communicate with Venue Owners via the Platform's messaging system.
  • Rate and review Venues after events, provided reviews are honest and based on actual experience.
  • Modify or cancel bookings as per the Refund and Cancellation Policy.

3.2 For Venue Owners

  • List Venues with accurate details such as photos, descriptions, pricing, availability calendars, amenities, and house rules (e.g., noise restrictions, decoration policies).
  • Manage bookings, including accepting/rejecting requests within 24 hours and updating calendars to avoid double bookings.
  • Receive payments (minus our service fees) after successful events, as per the Payment Gateway Policy.
  • Respond to Customer inquiries within 24 hours and maintain accurate listings. Failure to respond may result in penalties or reduced visibility.
  • Provide necessary permits, licenses, and insurance for Venues, ensuring compliance with local laws (e.g., fire safety, capacity limits).

3.3 Platform Role

We act solely as a facilitator connecting Customers and Venue Owners. We do not own, control, manage, or endorse Venues. All contracts for bookings are directly between Customers and Venue Owners. We are not responsible for the quality, safety, legality, or availability of Venues or events, nor for any disputes arising between users.

3.4 Prohibited Activities

You agree not to:

  • Use the Platform for illegal purposes, including fraud, money laundering, or hosting prohibited events (e.g., those violating local laws on gatherings).
  • Post false, misleading, defamatory, or harmful content (e.g., fake reviews, inaccurate Venue descriptions).
  • Harass, spam, discriminate, or infringe on others' rights, including intellectual property or privacy.
  • Reverse-engineer, scrape, or interfere with the Platform's functionality.
  • Use the Platform to solicit off-Platform transactions to avoid fees.
  • Damage Venues or fail to report damages during events. Violations may lead to account suspension, legal action, or reporting to authorities.

3.5 Acceptable Use

You must use the Platform in compliance with all applicable laws, including the Information Technology Act, 2000, Consumer Protection Act, 2019, and local regulations on events and venues. Customers must ensure events do not exceed Venue capacity or violate health/safety norms.

4. BOOKING PROCESS

4.1 Booking Requests

Customers submit booking requests via the Platform, including event details. Venue Owners must respond within 24 hours. Acceptance by the Venue Owner creates a binding contract between the Customer and Venue Owner. We facilitate but are not a party to this contract.

4.2 Payments

All payments are processed as per the Payment Gateway Policy. Customers pay an advance or full amount to confirm bookings. Venue Owners receive payouts after deducting our service fee (a percentage or fixed amount, displayed during listing). All prices are in INR and include applicable taxes unless stated otherwise.

4.3 Cancellations and Refunds

Handled as per the Refund and Cancellation Policy. Venue Owners must honor cancellations and not impose unauthorized penalties. We may mediate disputes but are not liable for outcomes.

4.4 Booking Modifications

Customers may request modifications (e.g., date changes, additional services) via the Platform. Modifications are subject to Venue Owner approval and may incur additional fees. If approved, updated terms will apply. We reserve the right to charge a modification fee.

4.5 Event Responsibilities

  • Customers: Comply with Venue rules, obtain necessary permits (e.g., for alcohol, music), ensure guest safety, and leave the Venue in good condition. Customers are liable for any damage, theft, or additional cleaning costs. Report issues immediately to the Venue Owner and us.
  • Venue Owners: Ensure Venues match listings, provide agreed amenities, maintain safety standards (e.g., fire exits, sanitation), and disclose any restrictions. Venue Owners are responsible for Venue maintenance and compliance with laws. Both parties must cooperate in resolving event-related issues.

5. FEES AND PAYMENTS

5.1 Service Fees

We may charge Customers a service fee for using the Platform, added to the booking amount and non-refundable except as per Policies. Venue Owners may incur listing, promotion, or payout fees, as specified during onboarding.

5.2 Taxes

All fees include applicable GST. You are responsible for any additional taxes, such as local entertainment taxes or withholding taxes. We will provide GST-compliant invoices.

5.3 Payouts to Venue Owners

Payouts are made within 7-10 working days after event completion (or no-show/cancellation resolution), minus fees and any deductions for damages/disputes. We may withhold payouts for ongoing investigations or violations.

5.4 Currency and Conversions

All transactions are in INR. International users may incur currency conversion fees from their banks; we are not responsible for such charges.

6. USER CONTENT AND INTELLECTUAL PROPERTY

6.1 User Content

You retain ownership of content you post (e.g., reviews, photos, Venue descriptions). By posting, you grant us a non-exclusive, royalty-free, perpetual license to use, display, modify, and distribute it on the Platform and for promotional purposes. You represent that your content is accurate, non-infringing, and complies with laws.

6.2 Platform IP

All Platform content (logos, designs, software, trademarks) is owned by us or licensors. You may not copy, modify, distribute, or use it without written permission. "BookMyMandap.in" is our trademark; unauthorized use is prohibited.

6.3 Feedback

Any suggestions or feedback you provide become our property without compensation or acknowledgment.

7. PRIVACY AND DATA PROTECTION

Your data is handled as per our Privacy Policy. We comply with the Digital Personal Data Protection Act, 2023 (DPDP Act), Information Technology Act, 2000, and relevant rules. By using the Platform, you consent to data processing as described.

8. DISCLAIMERS AND LIMITATION OF LIABILITY

8.1 Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee Venue availability, quality, safety, or fitness for purpose. We disclaim responsibility for user disputes, event outcomes, or third-party services (e.g., catering linked via Venues). Venue listings are provided by Owners; we do not verify them.

8.2 Limitation of Liability

To the extent permitted by law, our total liability for any claim is limited to the service fee paid for the disputed booking. We are not liable for indirect, consequential, incidental, or punitive damages, including loss of profits, data, or personal injury, even if advised of the possibility. This includes liability for events at Venues, such as accidents or property damage.

8.3 Indemnification

You agree to indemnify, defend, and hold us harmless against claims, losses, or expenses arising from your use of the Platform, violations of these Terms, your content, or disputes with other users (e.g., damage to Venues).

8.4 Insurance

We recommend that Customers and Venue Owners obtain appropriate insurance for events, including public liability and property damage coverage. We do not provide insurance and are not liable for uninsured losses.

9. DISPUTE RESOLUTION

9.1 Quick Resolution

For any issues, contact support@bookmymandap.in. We aim to resolve within 30 days through good-faith negotiations.

9.2 Governing Law

These Terms are governed by the laws of India, without regard to conflict of laws principles.

9.3 Jurisdiction and Arbitration

Exclusive jurisdiction lies with courts in Palakkad, Kerala. Disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, in Palakkad, with a single arbitrator appointed by us. The arbitration award is final and binding.

9.4 User Disputes

Disputes between Customers and Venue Owners (e.g., over damages) must be resolved directly. We may facilitate but are not obligated to intervene.

10. MISCELLANEOUS

10.1 Force Majeure

We are not liable for delays or failures due to force majeure events, as defined in the Refund and Cancellation Policy.

10.2 Severability

If any provision is invalid, the remaining provisions remain enforceable.

10.3 Assignment

We may assign these Terms without notice; you may not assign without our consent.

10.4 Entire Agreement

These Terms and Policies constitute the entire agreement, superseding prior understandings.

10.5 Waiver

No waiver of any term is effective unless in writing.
